TERMS OF SERVICE

1. Acknowledgment of Risks

You acknowledge that engaging in physical exercise and fitness training involves inherent risks, including but not limited to, the risk of injury, illness, or death. You understand that it is your responsibility to inform your personal trainer of any pre-existing medical conditions, physical limitations, or other factors that may affect your ability to safely participate in the training sessions.

2. Client Responsibilities

Provide accurate and complete information during the pre-exercise screening and any other assessments conducted by your personal trainer.

Follow the training program and instructions provided by your personal trainer to the best of your ability.

Inform your personal trainer of any changes in your health status, medical conditions, or physical limitations that may affect your ability to safely participate in the training sessions.

Seek medical advice before starting any new exercise program, especially if you have a history of heart conditions, respiratory issues, diabetes, or any other medical conditions that may require special consideration.

3. Personal Trainer Responsibilities

Create a personalised training program based on the client's needs, goals, and exercise preferences.

Monitor the client's progress and adjust the training program as necessary.

Provide guidance and support to ensure the client's safety during training sessions.

Refer the client to a medical practitioner if any signs or symptoms arise that may require further medical evaluation.

4. Limitation of Liability

Begin the Build coaches and personal trainers are not liable for any injuries, illnesses, or other medical conditions that may result from participating in the training sessions or following the training program.

You agree to release, indemnify, and hold harmless Begin the build and its personal trainers from all claims, liabilities, damages, or expenses arising from or related to your participation in the training sessions or use of any facilities or equipment.

This limitation of liability applies to any claims arising out of negligence, breach of contract, or any other cause of action.

5. Medical Clearance and Referrals

If you have any pre-existing medical conditions or physical limitations, you agree to obtain medical clearance from your healthcare provider before starting the training program.

Your personal trainer reserves the right to refer you to a medical practitioner if any signs or symptoms arise that may require further medical evaluation.

6. Payment and Cancellation Policies

Payment for personal training services is due according to the agreed-upon schedule and must be made in full before the start of each training session.

Payments will be an automatic withdraw

Cancellations for in person sessions must be made at least 24 hours in advance to avoid a cancellation fee. Failure to provide adequate notice may result in the forfeiture of the session fee.

7. Confidentiality

All personal information, including health and fitness data, shared with your personal trainer will be kept confidential and used solely for the purpose of creating and monitoring your training program.

8. Use of Facilities and Equipment

You agree to follow all rules and guidelines for the use of facilities and equipment provided by Begin the build

Begin the Build is not responsible for any injuries or damages resulting from the improper use of facilities or equipment.

9. Termination of Services

Either party may terminate the personal training services at any time with written notice.

In the event of termination, any fees paid in advance for unused sessions will be refunded on a pro-rata basis, if terminated by the personal trainer.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Australian Government.

Any disputes arising from or related to these terms and conditions will be subject to the exclusive jurisdiction of the Australian courts
